These Terms of Service govern access to and use of the Optimize Enterprise website. By using the website, you agree to these terms. If you do not agree, please do not use the website.
Consulting, assessment, implementation, and other professional services begin only after scope, responsibilities, fees, timing, and applicable terms are documented in a separate written agreement.
1. About this website
This website is operated by Optimize Enterprise LLC, a New York business optimization firm based in the Capital Region near Albany. It provides general information about the firm, its capabilities, its approach, and ways to begin a business discussion.
Website content is provided for general informational purposes. It is not an offer, proposal, promise to perform services, or guarantee that any particular engagement will be accepted.
2. No professional advice or client relationship
Nothing on this website is legal, financial, accounting, tax, clinical, engineering, safety, employment, cybersecurity, or other licensed professional advice. Visitors should obtain qualified advice for matters that require specialized judgment.
Visiting the website, clicking a link, or sending an email does not create a consultant-client, fiduciary, confidential, employment, partnership, or other professional relationship with Optimize Enterprise.
3. Information, estimates, and outcomes
Business conditions change and every organization is different. Optimize Enterprise works to keep website information useful and accurate, but does not warrant that every statement will remain complete, current, or suitable for a visitor's specific circumstances.
Examples of services, methods, possible improvements, timelines, or outcomes are descriptive only. Results depend on facts, access, decisions, implementation, market conditions, client participation, and other factors. No result is guaranteed through use of this website.
4. Communications and sensitive information
You may use the contact information on this website to describe a business question, complete the Business Opportunity Questionnaire, or request a conversation. A questionnaire is an initial inquiry and does not constitute an audit, diagnosis, proposal, or professional advice. Please do not include trade secrets, passwords, financial account information, medical information, protected personnel records, or other highly sensitive material in an initial email.
Optimize Enterprise may decline, redirect, or not respond to an inquiry. Any confidentiality, data-access, retention, or security obligations for a client engagement will be established in the applicable written agreement.
The Careers form may be used to submit a job application, résumé, employment history, qualifications, and supporting documents. Submission is not an offer of employment and does not guarantee review, an interview, a response, or a position. Applicants must provide accurate information and must not submit Social Security numbers, banking information, passwords, medical records, background reports, or government identity documents through the form or ordinary email.
5. Customer accounts, catalog, and cart requests
The website may permit a visitor to authenticate through a supported sign-in provider, create a customer profile, save catalog selections, and submit a structured request for written review. You are responsible for activity under your authenticated account and for providing accurate, lawful information. Do not attempt to access another person's account or private company tools.
Adding an item to a cart or submitting a cart request does not authorize a charge, complete a purchase, reserve service capacity, create an engagement, or bind either party. Digital products display fixed Launch Edition prices, but payment instructions, applicable taxes, license terms, delivery details, and any refund or cancellation terms are confirmed in writing before payment. Purchased files are delivered privately after cleared payment and are not made available through an unrestricted public download link.
Professional services require separately confirmed scope, price, timing, responsibilities, availability, and written terms. A cart may contain digital products, professional services, or both; each selection remains subject to the terms applicable to that type of item.
6. Intellectual property
The website and its original text, organization, presentation, graphics, branding, service descriptions, frameworks, and other content are owned by or licensed to Optimize Enterprise LLC and are protected by applicable intellectual-property laws. Optimize Enterprise, The Optimize Method™, and related names, materials, and methods may not be used in a way that implies affiliation, endorsement, or ownership without written permission.
You may view and print reasonable portions of the website for your own lawful, noncommercial evaluation. You may not reproduce, sell, publish, modify, reverse engineer, systematically extract, or commercially exploit website content without prior written authorization, except where the law expressly permits it.
A purchased single-purchaser digital product is licensed to one purchaser for that purchaser's internal business use. A team license covers only the number of named internal users and the single legal organization stated in the offer. Unless Optimize Enterprise gives separate written permission, digital products may not be resold, publicly posted, shared outside the licensed users, distributed to clients, used in a paid class or facilitation engagement, white-labeled, or used to create a competing product. The editable Operator Tools workbook is included only where expressly stated; editable source masters for the books are not sold.
7. Acceptable use
You agree not to use the website to:
- Violate a law or the rights of another person or organization.
- Transmit malicious code, attempt unauthorized access, or interfere with website availability or security.
- Misrepresent your identity or relationship with Optimize Enterprise.
- Collect website or visitor information through unauthorized automated means.
- Use the website or its content to create a misleading, unlawful, or infringing product or service.
8. Third-party websites and sign-in services
The website may link to independent websites, including The Optimize Method. A link is provided for convenience and does not make Optimize Enterprise responsible for another website's availability, security, content, terms, or privacy practices. Review the terms and policies of any third-party site you choose to visit.
Customer authentication may be provided through Sign in with ChatGPT. That provider's availability, account rules, and privacy practices are governed by its own terms. Optimize Enterprise does not receive or store your ChatGPT password.
9. Website availability and disclaimers
The website is provided on an “as available” basis. To the fullest extent permitted by law, Optimize Enterprise disclaims implied warranties relating to the website, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, and freedom from errors or harmful components.
Optimize Enterprise may update, suspend, restrict, or discontinue any part of the website when reasonably necessary, including for maintenance, security, compliance, or business reasons.
10. Limitation of liability
To the fullest extent permitted by applicable law, Optimize Enterprise LLC and its owners, personnel, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of, inability to use, or reliance on this website. Nothing in these terms limits liability that cannot lawfully be excluded or limited.
11. Governing law and separate agreements
These website terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, subject to any protections that applicable law does not allow the parties to waive. A signed client agreement controls if it conflicts with these terms on a matter concerning that engagement.
12. Changes and severability
These terms may be updated as the website or business changes. The effective date above will be revised when material updates are published. If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
